Is the Obama Administration's Affordable Care Act
Constitutional? Attorneys-general for 28 different states do not believe so. On
Monday, March 26, opening arguments commence on an historic three day session
in Florida v. United States Department of Health & Human Services, the
multi-state suit vs. the Affordable Care Act. It is the most hotly-anticipated
Supreme Court case in years – if not decades.
On Thursday, March 29, two of the country's most renowned health-care law
scholars will debate the merits of the case. Moderator Regina Rockefeller
(partner, Nixon Peabody Health Services division) will oversee Harvard Law
School Professor Einer Elhague argue in defense of the Act vs. Cato Institute
Senior Fellow Ilya Shapiro.
Join HBS and other Harvard alumni for this historic debate
on the appropriate role of government in the United States economy and healthcare
system. Following the Supreme Court's lead, the panel will debate whether:
- Congress
has the constitutional authority to enact the Act's individual mandate
provisions; and
- If
the individual mandate is not constitutional, can it be severed from the rest
of the Act?
- Or
is the individual mandate a necessary precondition for the law's other
provisions?
With the foundational role of the federal government in the
national economy and in the lives of ordinary Americans under scrutiny, this is
the biggest Supreme Court case of the year--and probably the most historic
decision since perhaps Roe v. Wade. You don't want to miss this compelling debate about the future of
America.
